La proposition de loi visant à garantir le respect du droit à l’image des enfants, connue sous le nom de « loi droit à l’image des enfants sur Internet », modifie le code civil pour intégrer explicitement ce droit dans l’exercice de l’autorité parentale. Elle pose que les parents protègent ensemble le droit à l’image de leur enfant mineur, dans le respect de sa vie privée, et qu’ils doivent l’associer à cet exercice selon son âge et sa maturité. En cas de désaccord entre les parents, le juge peut interdire à l’un d’eux de diffuser des images ou contenus relatifs à l’enfant sans l’accord de l’autre.

Si la diffusion porte gravement atteinte à la dignité ou à l’intégrité morale de l’enfant, une personne ou un service ayant recueilli l’enfant, ou un membre de sa famille, peut demander au juge de se voir déléguer l’exercice de ce droit. Le texte prévoit aussi que la CNIL peut saisir le juge pour obtenir le blocage d’un site en cas de non-exécution ou d’absence de réponse à une demande d’effacement de données portant atteinte aux droits d’un mineur. Adopté le 19 février 2024, il a été promulgué sous le numéro 2024-120.
